General terms and conditions

These terms and conditions govern your use of the services of Trustbox A/S. It is important that you read and understand the following terms and conditions before using Trustbox services. By using Trustbox services you agree to be bound by these terms and conditions. You may only use Trustbox services if you have the authority to enter into an agreement with Trustbox. If you use the services on behalf of a company/organization, you accept these conditions on behalf of the company/organization and confirm that you have authority to commit the company/organization to our outlined terms and conditions. In this case, “you / your” and “I” refer to the company/organization.
You may only use our services under these conditions.

Trustbox holds the right to modify/change/edit the offered services and content along the way without your permission and without informing you. We always strive,however, to inform all our customers and clients ahead in time.

Your files and personal information

Using our services allows you to upload/download information, files and folders to your Trustbox account (termed, “Your files”). You have full ownership of your files. Trustbox has no ownership over them. We have no right over your content/files or intellectual property beyond the basic rights that are necessary to have a functional service as described below. We would possibly need to require your permission to perform certain service functions, such as a request to “host” or “share” your files, edit “thumbnail image” or “document previews”. This extends into all design choices to technically administer our services to your account. You consent to give us permission in order for us to provide you an optimal standard of service. This permission extends to our trusted third-party companies that we work with in order to provide a functional and optimal service to you. You and only you are responsible for your behaviour, including the contents of your files and folders, and all communication with others used through our services. It is your responsibility to make sure that you have the necessary rights and permissions to comply with our outlined terms and conditions. You recognize that Trustbox does not have any obligation to monitor any information used on our services, however, if deemed necessary, Trustbox withholds the right to ensure that content complies with our guidelines
We are not responsible for the accuracy, completeness, appropriateness or legality of files, user posts, or other information accessible through our services. We are not responsible over the legal right of your communications and data traffic through our service in relation to Danish legislation.

Sharing Service

Our offers ‘file sharing’ service allows our customers to share a link to download files with third parties. You will receive an email, with the link to share. Clicking on the link opens a browser that initiates the download.

Adjustments and modifications of terms and conditions policy

We may revise these terms and conditions from time to time and the latest version will always be available on our website. After any adjustments and modifications of our services or website, you continue to agree to be bound by the revised terms and conditions. If you do not accept the new terms and conditions, please stop using our service and inform us in writing of your cancellation. Any customer’s violation or abuse of these terms, Trustbox reserves the right to terminate the agreement without financial compensation or refund. Trustbox reserves the right at any time to terminate the agreement without the customer reclaiming their prepaid amount or remaining subscription balance. Trustbox is not liable in any way to customers, either economically or in terms of lost data, both directly and/or indirectly upon termination. It is the customer’s responsibility to always keep themselves updated of Trust box’s latest terms and conditions.

Software and Updates

Some of our services require you to download our software. Trustbox hereby grants you a limited, non-exclusive, personal and revocable license to use the software solely to access the services. Your license to use the software will automatically be revoked if you violate the terms and conditions in any way that violates our intellectual property rights. You do not have permission to alter our services or products in any way, be it in the form of reverse engineering, decompiling or any similar attempts. Your device will automatically update our software when a new version is available. Your acceptance of these updates are required in the terms and conditions.

Account Security

You are responsible for protecting the password that you use to access our software and you agree that you will not disclose this to third parties. You are responsible for all activity on your account, whether you directly consent it or not. You must immediately notify Trustbox if you detect any unauthorized access or activity on your account.
As a new customer, you will be sent an email with first/time login information after payment. It is the customer’s responsibility to change this login information to something personal and to secure them.

Ultra Safe and Ultra Safe Max

At Trustbox safety is an important keyword. We have many different encryption layers, enabling our customers to tailor their level of security as desired. With our Ultra Safe and Ultra Safe Max services, we assign unique encryption keys to customer, allowing only the customer to be able to unlock and gain access to their encrypted files. Ultra Safe Max, has in addition, a passphrase as a further security step.
As the encryption key is random and is only given to the customer, Trustbox is unable to help access the account and files if the password is lost. Lack of entry options limits Trust Box´s ability to regain files, so the customer agrees to accept all responsibility for their data.

Your general responsibilities

You are prohibited from sharing/ copying/ downloading/uploading files that you do not have rights to. You alone, not Trust box, are fully responsible and committed in terms of what you copy, share, upload and download or in relation to other uses, while using Trust box services. You may not upload spyware or any other malicious software to the service. You alone are responsible for maintaining and protecting all your files. Trust box will not be liable for any loss, corruption or costs associated with the backup or restoring your files. If your contact information or other information associated with your account is changed, you must notify us as soon as possible so we can update your information.

Selecting files for backup

It is always the customer’s responsibility to ensure the continuous backup of your data. During the installation of Trust box’s software, the customer will be able to assign multiple backup tools, for example the Smart scanner. The Smart scanner scans only for the requested file types and locations.
If the customer selects the Easy Setup option during installation on a Windows device, an automatic backup of the devices public folder locations(Desktop – Documents – Photos – Music – Video) will be done.
Select Advanced Setup during the installation phase, to setup and choose an encryption level, choice of folders for backup and run times. In all cases, it is the customer’s responsibility to ensure the correct selection is chosen during installation. If you have any doubts or questions, please don’t hesitate to contact our customer support service via email or telephone.

Limitation of Liability

Services and software are provided “as is” at its own risk, without express or implied warranty or condition of any kind. We disclaim any guarantee of merchantability, fitness for a particular purpose or infringement. Trustbox is not responsible for any damage to your computer system, loss, corruption or damage of data using our software and services. To the fullest extent permitted by law, under no circumstances will Trustbox, its affiliates, directors , employees, agents, suppliers or licensors are liable for any indirect, special, incidental, punitive, exemplary or consequential (including loss of use, data, business or profits) damages, regardless of legal theory, whether Trustbox has been warned of the possibility of such damages, even if an undertaking does not fulfill the intended purpose.

Termination

You can stop using Trustbox’s services at any time. Please be aware that the notice period is the current month plus 30 days. You can cancel your agreement either through your personal site online or by sending us an email at opsig@trustbox.dk. We reserve the rights to suspend, discontinue or terminate our service at any time with or without cause and with or without notification. For example, we may suspend or terminate your use of our service if you do not comply with these terms and conditions or use the service in a way that may harm Trustbox. If we suspend or terminate your agreement and service, we will try to give you advance notice and help you to retrieve your files. In special cases we may terminate the use of your service without notice, for example if there is a serious breach of the stated terms and conditions. If we terminate your use of our service due to violation of our terms and conditions, there will not be any form of financial reimbursement.

Payments

All payments made for the services of Trustbox must comply with the current prices on our website and must be paid in advance. We have the right to change the prices and to cancel or offer different features of a service. We will inform you by email if we make changes to our services. If you continue to use our product after you have been informed of any price or product changes, it will be considered as your acceptance. All payments for our services must be paid in advance, and your payment will automatically be deducted within your chosen subscription period. If you choose to pay by credit or debit card, you accept that we will automatically withdraw money from your account.
If you wish to cancel your payment method at Trustbox, you must notify us by writing to opsig@trustbox.dk. All payments to Trustbox are non refundable, unless it is included in the terms and conditions. You agree that you can not withdraw your payment through your bank for payments to Trustbox. If you do not accept this, you will be held responsible for all costs that will be occur with this action.
In the absence of payment Trustbox reserves the right to immediately block, close or to make your account and services inaccessible.

Additional conditions of using Trustbox backup services

With Trustbox you have several backup safety levels. Including Ultra Safe and Ultra Safe Max. At our highest levels of security, we are excluded from being able to assist our customers files as security is so high that even we and our warehouse, do not have the encryption keys for our customers files. As a customer, you can request that we do not have access to the encryption key, giving you the sole ability to access your backup data. This allows for a 100% private account which only you can access, removing Trustbox`s support opportunities, which is why we recommend you carefully consider this service before purchase.
Trustbox provides you with backup tools that can be set to automatically delete files in the cloud and on your device over a set time period. It is the customer’s sole responsibility to select the desired settings and tools in either settings or during installation. Our default setting is the ‘Forever Safe’ service, which retains deleted files in the cloud after they have been locally deleted on your device. Our support team are always easy to help and assist you if you have any issues or doubts.

Acceptable use

You agree that you will not abuse Trustbox services. For example, do not, and do not try, to use the services for the following reasons:
1. Probe, scan or test the weaknesses in systems or networks.
2. Circumvent any security or authentication.
3. Send virus, overloading, flooding or spamming.
4. Plant malware or sending malware through our services.
5. Send advertisements, spam or other forms of false information (also known as “spoofing or” phishing “)
6. Do not break Danish law in any way by the use of our software, product or service.

Proof of purchase with card

All customers of Trustbox who purchase our service with credit (debit/etc?) card will automatically receive a receipt of the transaction .

Renewing / Deleting payment card

If you renew or delete your card associated with the payment method please inform us at info@trustbox.dk. Do not disclose any card details are given, simply inform us that you are changing your payment details. The customer has to edit and renew the card details in the website’s customer side.

Subscription services

Trustbox’s subscription service enables you to pay with your credit/debit etc?? card. After payment, invoices will be forwarded and debited automatically to your card, sparing you from invoice fees. As safety is paramount to us, we will store your card details in DIBS Denmark’s secure payment system, allowing only the need to enter your card details once. The subscription ends only when terminated. The subscription will be automatically renewed for the chosen period (see cancellation terms).

Monthly paying customers get billed every month on the 2nd. The first month is settled in full upon the initial purchase of Trustbox’s services. The following month you pay only for the days that are up to the 2nd of the month. For example, if you buy a Trustbox’s service on 21st February, the following month you will only pay for the days that are up to 2nd March (paying for 9/10 days).

Cancellation

As a private customer, you have a 14 days cancellation period as long as the service has not been used. The cancellation period expires after 14 days from your purchase. If you purchased our services is in one of our cooperative stores, the cancellation must be undone in the same store. Business customers have no cancellation policy according to the Sale of Goods Act?? unless otherwise agreed in writing.

Newsletter and contact through email

When ordering a Trustbox service, you authorize Trustbox to contact you by e-mail.
Our newsletters may contain information about new and upcoming services, tips to further secure your data or relevant news. You can unsubscribe at any time by writing to us at info@trustbox.dk or by clicking the ‘unsubscribe’ link in the newsletter footer. Trustbox will not sell your contact information to a third party.

Setup fee

It will always be clearly be stated on our website, if there is any setup fee associated with your chosen Trustbox service.

Computer Limits

It is not necessary to purchase a different Trustbox service for different devices. Our website clearly indicates exactly how many devices your chosen service is licensed for.

Upgrades / Downgrades

You can freely upgrade or downgrade your Trustbox service at anytime. Once the change has been made our service is automatically adjusted. Upgrades and downgrades will be automatically regulated at the next renewal date where you will receive a new payment invoice. Please contact our support team to change our service capacity.

Where is my data stored?

As safety is our top priority at Trustbox, we insure optimal security and match needs of your data by using different data centers located in Europe and US. Our professional data servers have a 99.99% uptime rate.

User logins

With Trustbox, you can create separate login accounts for your single backup solution. Space allocated to each login account is regulated under your Trustbox Dashboard. You can always freely adjust the amount of data space each user is allocated, which is limited to the overall space limitation of your chosen service package. If you need more space, you can easily upgrade by buying additional space.

File versions

Trustbox backs up unlimited file versions of your data. All uploaded versions are saved on our servers, so you have the opportunity to “jump back in time” if you rewrite/overwrite by mistake. You can specify where the file versions are saved under the version rules. The latest version will always be the displayed on your Trustbox Dashboard.

Backup File Types

To achieve as stable a product for our customers as possible, Trustbox withholds the right to adjust our restrictions for file types accepted for a Trustbox backup. It is the customer’s responsibility to stay updated for any changes made via Customer Knowledge page and terms and conditions.

Forever Safe and storage

Trustbox has several options for saving files directly in the cloud; including our Forever Safe option. Files that are solely stored in the cloud, will be permanently gone if you manually delete these. This is irreversible and we therefore require your confirmation before performing this action. As a customer you have sole responsibility to understand the features of the various storage choices and possibilities offered by Trustbox.

Website error rates, typos, etc.

Trustbox reserves the right to cancel or withdraw a particular agreement, in the case of pricing errors, typos or misprinted information. Trustbox does not bind itself to any misleading or misstated information.

The ‘WIPE’ feature

Trustbox’s WIPE feature allow you to erase remotely all backup storage on your device, via the Trustbox Dashboard. We advise caution using this feature, as it can leave the device useless and even without an operating system. Caution, warnings will be visible on your Trustbox Dashboard if feature is activated. This feature can be used, for example, if the circumstances arises where your device is stolen and you want to be sure that your files do not get into the wrong hands.
We recommend that you speak to one of our customer support staff before activating this feature if you have any doubt.
The outcome of using the feature is the customer’s sole responsibility.

Backup mobile devices

Trustbox offers products and services that allow backup of mobile devices with iOS and Android systems. Trustbox backup software indicates which files your mobile device grants permission to backup. The default backup setting on mobile devices is ‘Forever Safe’. This feature enables files to be backed up and saved forever in the cloud, where it is your responsibility to delete unwanted files from the Trustbox Dashboard. Please contact our customer support team if you are unsure your contract includes this feature.
